Terms of Service

Welcome to PopUpAt. By using our platform, you agree to these Terms of Service. If you don't agree, please don't use PopUpAt.

1. What PopUpAt Is (and Isn't)

PopUpAt is a matchmaking platform that connects local venues and vendors for pop-up collaborations. We help you find each other—that's it.

We are NOT:

• A booking agent or event coordinator
• A payment processor for partnerships
• A dispute mediator or referee
• Insurance or legal counsel
• Responsible for what happens after you connect

2. User Accounts

To use PopUpAt, you need to create an account. You're responsible for:

• Providing accurate information in your profile
• Keeping your login credentials secure
• All activity that happens under your account
• Notifying us if your account is compromised

You must be at least 18 years old to use PopUpAt. One person or business per account, but you can create multiple profiles (venue and/or vendor) within that account.

3. Using the Platform

You agree to:

• Be honest in your profile and communications
• Respect other users and their businesses
• Follow through on commitments you make
• Not use the platform for illegal activities
• Not harass, spam, or scam other users
• Not scrape or data mine the platform

We make no guarantees about:

• The quality or reliability of users you connect with
• Whether partnerships will be successful
• The accuracy of information in user profiles
• Uninterrupted or error-free service

4. Partnerships & Financial Arrangements

Any arrangements you make with other users—whether financial or otherwise—are entirely between you. PopUpAt is not involved in:

• Negotiating terms of your partnerships
• Processing payments between users
• Enforcing agreements or contracts
• Mediating disputes

If money changes hands between you and another user, that's your business. We don't track it, don't take a cut, and aren't responsible for it.

5. Beta Period & Service Availability

During Beta (through October 30, 2025): Features may not work perfectly, things might break, and we're learning as we go. Your patience and feedback are appreciated.

After Beta: We'll do our best to keep PopUpAt running smoothly, but like any website, occasional bugs or downtime may happen. We'll fix issues as quickly as possible. This is a nights-and-weekends project, so response time may be a day or two.

6. Subscription & Billing

During Beta (through October 30, 2025):

• All users have free access
• You may optionally add a credit card to support us (not charged until October 30, 2025)

After Beta (October 30, 2025 onward):

• Subscription is $5/month (includes 1 profile + browse access)
• Additional profiles are $1/month each
• Billing is monthly, charged automatically
• You can cancel anytime from your account settings
• When you cancel, your profile stays active through the end of your billing period, then becomes inactive
• No refunds for partial months

Payment processing is handled by Stripe. We don't store your credit card information.

7. Intellectual Property

You own the content you post (profile info, photos, descriptions). By posting it on PopUpAt, you give us permission to display it on the platform and in marketing materials (if we choose to).

PopUpAt owns the platform itself—the code, design, branding, etc. Don't copy or steal it.

8. Liability Limits

PopUpAt is not liable for:

• Disputes between users
• No-shows, cancellations, or broken agreements
• Financial losses from partnerships
• Damages, injuries, or issues arising from pop-up events
• Data loss or platform outages
• Anything that happens after you connect with another user

Use PopUpAt at your own risk. We're the introduction service, not the insurance company.

9. Termination

You can: Cancel your subscription anytime from your settings page. When you cancel, your profile stays visible through the end of your billing period. If you want to hide your profile immediately, you can mark it as inactive or delete it from your settings.

We can: Suspend or terminate your account if you violate these Terms, harass other users, or do anything else that makes PopUpAt worse for everyone. We'll try to give you a heads up, but we don't have to.

10. Changes to These Terms

We may update these Terms occasionally. If we make significant changes, we'll let you know via email or a notice on the platform. Continued use after changes means you accept the new Terms.

11. Governing Law

These Terms are governed by the laws of New York State. Any disputes will be resolved in New York courts. (We're based in Albany, NY.)
